Shelfsnap is operated by Matthew Schmidt ("Shelfsnap", "we", "us", "our"). By accessing or using Shelfsnap (the "Service"), you agree to these Terms & Conditions. If you do not agree, do not use the Service.
1. Who can use Shelfsnap
You must be of legal age in your jurisdiction to enter a contract, and if you use the Service on behalf of an organization you confirm you have authority to bind that organization. You are responsible for keeping your account credentials confidential and for all activity under your account. Provide accurate information and keep it up to date.
2. The Service
Shelfsnap turns photos of shelves into digital lists (books, media, and similar inventory) and offers optional paid plans with higher limits and additional features. We may change, suspend, or discontinue features at any time. The Service is provided on an "as is" and "as available" basis; we do not guarantee uninterrupted or error-free operation.
3. Acceptable use
You agree not to:
- use the Service for any unlawful purpose or to violate any law;
- upload content you do not have the right to use, or that infringes intellectual property, privacy, or other rights;
- send spam, attempt fraud, or impersonate others;
- probe, scan, or test the Service's security; introduce malware; scrape or crawl the Service except as expressly permitted;
- reverse engineer, decompile, or attempt to derive source code, except to the extent applicable law permits;
- resell, redistribute, or circumvent technical limits of the Service.
4. Intellectual property
We retain all right, title, and interest in the Service, including software, documentation, branding, and design. Subject to these terms we grant you a limited, non-exclusive, non-transferable, revocable right to use the Service for your internal purposes within the plan you have paid for. You retain ownership of the content you upload ("Your Content") and grant us a limited license to host, store, process, and display Your Content solely to provide and improve the Service.
5. Payments, subscriptions, and refunds
Paid plans are billed in advance on a monthly or annual basis and renew automatically until cancelled. Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns. Payment, billing, tax, cancellation, and refund mechanics are governed by Paddle's Checkout Buyer Terms. See our Refund Policy for our 30-day money-back guarantee.
6. Suspension and termination
We may suspend or terminate your access if you materially breach these terms, fail to pay fees, present a security or fraud risk, or repeatedly violate our policies. On termination your right to use the Service ends; we may delete Your Content after a reasonable export window.
7. Warranty disclaimer
To the fullest extent permitted by law we disclaim all implied warranties, including merchantability, fitness for a particular purpose, and non-infringement. Shelfsnap uses AI to extract text and items from photos; results may be inaccurate or incomplete and should be verified before you rely on them.
8. Limitation of liability
To the fullest extent permitted by law, our aggregate liability for any claim arising out of or relating to the Service is limited to the fees you paid us in the 12 months before the claim. We are not liable for indirect, consequential, special, or incidental damages, including loss of profits, data, or goodwill. Nothing in these terms excludes liability for fraud, death, or personal injury where such exclusion is prohibited by law.
9. Indemnity
You agree to indemnify us against claims arising from Your Content, your unlawful use of the Service, or your breach of these terms.
10. Changes
We may update these terms from time to time. Material changes will be announced in-app or by email. Continued use of the Service after changes take effect constitutes acceptance.
11. Governing law
These terms are governed by the laws of the seller's jurisdiction (United States), without regard to conflict-of-law rules. The courts of that jurisdiction have exclusive jurisdiction over any dispute, subject to mandatory consumer protections that may apply where you live.
12. Assignment and force majeure
You may not assign these terms without our consent; we may assign them in connection with a merger, acquisition, or sale of assets. Neither party is liable for delays or failure caused by events beyond reasonable control.
